Chapter Number: 401This bill enacts conforming changes to statutes to reflect the assignment and reorganization of the functions of state government pursuant to the Governor's Reorganization Plan No. 2 of 2012 (GRP No. 2). The bill reallocates specified duties of reorganized and abolished state entities and their officers to established state entities and officers, including, but not limited to, reallocating specified duties of the abolished Business, Transportation and Housing Agency and its secretary to the Governor's Office of Business and Economic Development, the Transportation Agency and its secretary, and the Business, Consumer Services, and Housing Agency and its secretary. As it relates to the Commission, the bill amends Business and Professions Code section 19869 to require a request for withdrawal of any application to be filed with the Department of Justice, instead of the Commission.

This bill closes a loophole that allowed Internet gambling sweepstakes to operate in Internet cafés. This bill applies the existing prohibitions for unfair acts or practices related to persons operating any contest in Business and Professions Code section 17539.1 to include sweepstakes, as specified. The major provisions of the bill: (1) prohibit using or offering to use any method intended to be used by a person interacting with an electronic video monitor to simulate gambling or play gambling-themed games in a business establishment that implements the predetermination of sweepstakes cash, cash-equivalent prizes, or other prizes of value, or otherwise connects a sweepstakes player or participant with sweepstakes cash, cash-equivalent prizes, or other prizes of value; (2) specify that nothing shall be deemed to render lawful any activity that is unlawful pursuant to any other law, or deemed to render unlawful or restrict otherwise lawful games and methods used by a licensed gambling enterprise (cardroom) or operations of the California State Lottery; and, (3) create a non-reimbursable State-mandated local program.

This bill creates the Tribal Nation Grant Fund in the State Treasury, to be administered by the California Gambling Control Commission, for the receipt and deposit of moneys received by the state from Indian tribes pursuant to the terms of tribal-state gaming compacts. The bill authorizes moneys in this fund, upon appropriation by the Legislature, to be used for discretionary distribution to nongaming tribes and limited gaming tribes for purposes related to effective self-governance, self-determined community, and economic development.

This bill, an urgency measure, ratifies the Amended and Restated tribal-state gaming compact entered into between the State of California and the Viejas Band of Kumeyaay Indians, executed on August 12, 2014.
