Summary: Section 1 of this Budget Trailer bill makes changes to the Gambling Control Act related to the criteria for mandatory denials for license applicants. The Act, among other things, generally requires a person to be licensed by the Commission to participate in operation of a controlled game. The Act requires the Commission to deny a license to an applicant who has been convicted of a felony, including a conviction by a federal court or a court in another state for a crime that would constitute a felony if committed in California. This bill excepts from the requirement to deny a license a conviction of a felony for the possession of cannabis, the facts of which would not constitute a felony or misdemeanor under California law on the date the application for a license is submitted. This bill contains other related provisions and other existing laws.

Summary: The Gambling Control Act, provides for the licensure and regulation of various legalized gambling activities and establishments by the Commission and the investigation and enforcement of those activities and establishments by the Department of Justice. The Act prohibits, until January 1, 2020, an ordinance in effect on January 1, 1996, that authorizes legal gaming within a city, county, or city and county from being amended to expand gaming in that jurisdiction beyond that permitted on January 1, 1996. The Act also requires any amendment to any ordinance that would result in an expansion of gambling, as defined, in the city, county, or city and county, to be submitted for approval to the voters of the city, county, or city and county and to be approved by a majority of the electors voting thereon in order to be valid, except that an ordinance may be amended without the approval of the electors to expand gambling by a change that results in an increase of less than 25% with respect to specified matters, including the number of gambling tables or the hours of operation of a gambling establishment in the city, county, or city and county. This bill authorizes a city, county, or city and county to amend its ordinance to increase the operating hours of a gambling establishment to up to 24 hours a day, 7 days a week.

Summary: This bill prohibits a member of the Commission, the Executive Director, the Chief of the Bureau of Gambling Control within the Department of Justice, any employee of the Commission, and any employee of the Department of Justice who works on or supervises over gambling issues for a period of 2 years after leaving office or terminating employment, from holding a direct or indirect interest in, holding employment with, representing, appearing for, or negotiating on behalf of, a gambling establishment, gambling enterprise, registrant, or licensee.

Summary: The Alcoholic Beverage Control Act, administered by the Department of Alcoholic Beverage Control, prohibits any licensee from giving any premium, gift, or free goods in connection with the sale or distribution of any alcoholic beverage, but permits alcoholic beverages to be provided in consumer contests and sweepstakes subject to specified conditions. Existing law permits the department to issue a special temporary on-sale or off-sale beer or wine license to certain nonprofit corporations that entitles the licensee to sell beer or wine, as specified. Existing law generally makes it a misdemeanor for a person to sell chances in a lottery, but excepts from this prohibition a charitable organization that has been registered with the Department of Justice that conducts a raffle pursuant to certain requirements. This bill would authorize a nonprofit corporation issued a special temporary on-sale or off-sale beer or wine license and that also obtains a raffle registration to offer, provide, or award alcoholic beverages as a prize in a raffle.
