AB 1168 (Gipson, Chapter 744, Statutes of 2018) Gambling: local moratorium.

This bill extends the moratorium on cardroom gambling expansion from January 1, 2020 to January 1, 2023. Specifically, it extends the gambling moratorium regarding the expansion of gambling on existing cardrooms and the issuance of new State cardroom licenses.

OTHER GAMING

AB 888 (Low, Chapter 575, Statutes of 2018) Charitable raffles.

This urgency bill extends the sunset date for 50/50 raffles conducted by private, nonprofit organizations established by, or affiliated with, specified professional sport teams or organizations from December 31, 2018 to January 1, 2024. This bill also makes numerous changes to the existing program, including: 1) restructuring the annual reporting requirements and requiring a new per-raffle report; 2) requiring the Department of Justice to double the minimum annual fees to participants to cover costs for administration and enforcement; 3) entitling Department of Justice to reimbursement from registrants for costs associated with auditing and reviewing raffle reports; and 4) extending the loan repayment date to the General Fund from December 31, 2018 to December 31, 2023, among other changes.

Effective Date: September 20, 2018

Note: The regulation and enforcement of sports raffles is under the jurisdiction of the Department of Justice.


TRIBAL

AB 880 (Gray, Chapter 801, Statutes of 2018) Tribal Nation Grant Fund.

Existing law establishes the Tribal Nation Grant Fund; this bill establishes a programmatic framework for the Tribal Nation Grant Program and defines the roles and responsibilities of various entities that establish and implement the program. Specifically, this bill: 1) establishes the Tribal Nation Grant Panel (Panel) and the office of the Governor's Tribal Advisor (Advisor); 2) requires the Advisor to appoint members of the Panel by January 1, 2020; 2) requires the Panel to award grants and comply with the Bagley-Keene Open Meeting Act; 3) requires the California Gambling Control Commission (Commission) to act as the limited trustee and provide numerous administrative support services to the Panel; 4) specifies the authorized uses of grant funds; 5) requires grants to be awarded to eligible tribes on a competitive grant application basis; 6) authorizes the Bureau of Gambling Control within the Department of Justice to conduct audits on the use of grant funds; and, 7) establishes annual reporting requirements for the Commission and the Panel beginning July 15, 2020, among other provisions.

AB 1433 (Wood, Chapter 11, Statutes of 2018) Tribal gaming: compact ratification.

This urgency bill ratifies the tribal-state gaming compact entered into between the State of California and the Elk Valley Rancheria, executed on August 31, 2017. The bill provides that, in deference to tribal sovereignty, certain actions related to that compact are not projects for purposes of the California Environmental Quality Act.

AB 1817 (Committee on Budget, Chapter 37, Statutes of 2018) State government.

This budget trailer bill, among other provisions, establishes an annual process, beginning December 15, 2018, requiring the Department of Finance (Finance), in consultation with the California Gambling Control Commission (Commission), to determine if there is an excess in total revenues estimated for the Indian Gaming Special Distribution Fund (Fund). Subject to the determination and approval of Finance, this bill requires the Commission to apply any excess revenues, on a proportionate basis, to offset the pro rata share payments required to be made to the Fund by limited gaming tribes, as specified. The bill applies to limited gaming tribes for the period that the tribe is obligated to contribute to the Fund pursuant to its Tribal-State Gaming Compact. This bill took effect immediately.

This urgency bill ratifies the tribal-state gaming compact entered into between the State of California and the Big Valley Band of Pomo Indians of the Big Valley Rancheria, executed on August 16, 2018. The bill provides that, in deference to tribal sovereignty, certain actions related to that compact are not projects for purposes of the California Environmental Quality Act.

This urgency bill ratifies the amendment to the tribal-state gaming compact entered into between the State of California and the Habematolel Pomo of Upper Lake, executed on August 16, 2018. The bill provides that, in deference to tribal sovereignty, certain actions related to that amended compact are not projects for purposes of the California Environmental Quality Act.

SB 1051 (Dodd, Chapter 846, Statutes of 2018) Tribal gaming: compact ratification.

This urgency bill ratifies the tribal-state gaming compacts entered into between the State of California and the following Indian tribes: the La Jolla Band of LuiseƱo Indians, the Mechoopda Indian Tribe of Chico Rancheria, the San Pasqual Band of Mission Indians, the Torres-Martinez Desert Cahuilla Indians, and the Twenty-Nine Palms Band of Mission Indians. The bill also ratifies the amendment to the tribal-state gaming compact between the State of California and the Dry Creek Rancheria Band of Pomo Indians, executed on August 1, 2018, and the amendment to the tribal-state gaming compact between the State of California and the Karuk Tribe, executed on August 1, 2018. The bill provides that, in deference to tribal sovereignty, certain actions related to these compacts and amended compacts are not projects for purposes of the California Environmental Quality Act.
